WARRANTY CARD

 

Guarantor - the entity providing the guarantee, i.e. the company under the name GunGan sp. z o.o., based in Wrocław at 4/310 Boczna Street, NIP: 8992819315, KRS: 0000679280

Buyer - a natural person, legal entity or organizational unit that is not a legal entity, who purchased the product directly from the Guarantor.

Service - a third party cooperating with the Guarantor

 

Warranty Terms and Conditions

1.    GunGan Ltd. provides buyers with a guarantee of proper operation of the product for a period of time:

a. one year - for products with closed airflow, i.e. those to which the inflatable does not have to be permanently connected (e.g. Bumper Balls, water balls, water pools),

b. two years for the material and one year for the seams - for products with a constant air supply, i.e. those to which the blower must be permanently connected (e.g. inflatable playgrounds, inflatable slides, obstacle courses, etc.).

d. on floating water parks - a two-year warranty applies.

e. for other products that do not fall within the above framework, such as Archery Tag - a one-year warranty applies.

2.    The indicated warranty period is calculated from the date of release of the product - unless something else follows from the content of the concluded contract.

3.          Warranty benefits cover only the country in which the product was purchased. 

4.    If a physical defect in the product occurs during the warranty period due to the fault of the manufacturer, the Buyer is entitled to repair the damage free of charge,

 

5.    The warranty does NOT cover damage caused by:

 

a.    mechanical damage,

b. damage caused during transport and handling of the product

c. improper use of the product, carelessness of the Buyer or use of the product contrary to the instructions for use or applicable regulations or standards,

d. damage or malfunction resulting from circumstances beyond the control of the Guarantor or force majeure, including, but not limited to, fire, flood, lightning, other natural disasters (including winds over 15 knots) or other unforeseen accidents, surges in the telephone or power grid, incorrect supply voltage, connection to an ungrounded power outlet

e. in the case of water slides, water parks, water pools and other products, the use of which is associated with the use of water - placing the product on uneven terrain or filling any component of the product with (i) any liquid other than water or (ii) water in excess of 70% of its capacity

f. in the case of pumped equipment - exceeding the maximum pressure value or failure to use pumping equipment in accordance with the instructions or DTR documentation,

g. normal wear and tear of the product,

h. modifications, alterations, tune-ups or repairs made by other than the Guarantor's designated Service,

i.      damage or defects occurring after the warranty period.

j. the warranty does not cover damage to: D-rings (attraction mounting brackets), steps, handles and replacement slides (applies to all inflatables).

 

6.The Buyer forfeits the Warranty if:

 

a.       Making alterations, modifications or fine-tuning by anyone other than the Guarantor, its subcontractors or the Guarantor's designated Service Center,

b. use of products during the months of November-March and when the ambient temperature drops below 10o Celsius,

c. failure to adequately dry the product before storage,

d. failure to provide an adequate layer insulating the product from the ground,

e. resale of the product.

f. in the case of floating water parks - the condition for maintaining the warranty is to inform the Guarantor in writing about the disassembly of the floating water park for the period from November to March, up to one week from the date of disassembly. The dismantling must take place outside the indicated period. To avoid ambiguity, the buyer forfeits the warranty in case of failure to inform and in case of failure to dismantle the park before the November-March period. 

 

7.   The warranty applies only to those who purchased the product directly from the Guarantor. The warranty does not extend to subsequent purchasers of the product.

(8 Warranty services are provided by the Guarantor's designated Service Center.

 

9.    Before sending the defective product, you need to report the failure to the Guarantor. To do this, you need to:

 

a.    Document the defects and faults of the product with an indication of the reason for them,

b. send photos with a detailed description of the technical problem and proof of purchase to the store's email address,

c. wait for the Guarantor to process the warranty claim.

 

10.  The Guarantor reserves the right to request from the Buyer further information necessary to process a warranty claim

11.  After the complaint is accepted, the Guarantor will inform the Buyer of the address of the Service Center that will carry out repairs. The device should be:

a. Deliver directly to the Service Center designated by the Guarantor OR

b. send to the Service Center indicated by the Guarantor

12.  The guarantor reserves the right to unilaterally choose the method of removal of the defect, in particular if technological or technical considerations warrant it.

13. Guarantor shall bear the cost of shipping (Guarantor will personally order a courier to the Buyer. The Buyer may not send the device to the Guarantor and Service without the knowledge of the Guarantor) two ways if the complaint is accepted. Otherwise, the two-way shipping cost is covered by the Buyer.

14.  Defects disclosed during the warranty period will be repaired by the Guarantor within the period agreed by the parties, but no longer than 30 working days counted from the date of acceptance of the product for repair by the Service indicated by the Guarantor.

15.  If the repair requires the import of spare parts from abroad, the repair period is extended accordingly - of which the Guarantor or Service will notify the Buyer.

16.  To the extent not regulated, the relevant provisions of the Civil Code on quality warranty on sale shall apply.
